TERMS & CONDITIONS

Approval of your application is subject to the following:

• Fully completed, dated and signed Membership Agreement, Waiver of Liability & Debit Order Authority forms
• Membership Activation Fee will be added to your first debit order
• Payment of the first month’s membership fee, payable by debit order in arrears

Date of Membership Inception

Your membership will commence on the date specified on the membership contract listed above. You shall be entitled to make use of the facility in line with the membership option that you have selected. Memberships will remain in force indefinitely, until such time that your contract is either cancelled by yourself or by Performance Purist (Pty) Ltd in writing. Due to the nature of the industry, Performance Purist (Pty) Ltd reserves the right to withdraw parts of or full use of the facility and/ or equipment at any time and without notice for any period due to required and/ or planned repairs and maintenance, alterations, replacement of facilities and/ or equipment for safety and service delivery reasons, or any other reason as may be deemed necessary.

Membership Cancellation

You reserve the right to cancel this membership contract anytime within the first 30 (thirty) days, with no notice period. Should the cancellation only be affected after the debit order run has been submitted to the debit order provider, usually within the last 10 (ten) days of each month, you shall still be liable for the 1st (first) month’s debit order premium payment, despite the cancellation. Following the first 30 (thirty) days, you will thereafter be subjected to a 30 (thirty) day written cancellation notice.

Cancellations will only be accepted via an email addressed to info@performancepurist.co.za

Should you issue a cancellation notice in the middle of a calendar month, Performance Purist (Pty) Ltd reserves the right to charge for the 30 days notice period required (pro rata billing for the next month). The amount due to Performance Purist (Pty) Ltd will be calculated by using your selected contract option premium, dividing it by 30 (thirty) days and then multiplying it by the number of days applicable until the 30 (thirty) day cancellation notice period is reached.

Performance Purist (Pty) Ltd reserves the right to cancel this contract with immediate effect should you fail to abide by the rules and regulations of the facility, as so determined by Performance Purist (Pty) Ltd from time to time, or if you breach the terms of this contract. Performance Purist (Pty) Ltd reserves the right to terminate your membership should Performance Purist (Pty) Ltd deem that you are not physically and/ or medically capable of proceeding with normal exercise, or if Performance Purist (Pty) Ltd finds the information provided by yourself to be false or untrue.

In the event of any of the above terms and conditions being unenforceable, same will be deemed to be severable from the remainder of this contract and you are not entitled to cede any of the terms of this contract.

Performance Purist (Pty) Ltd shall be entitled, at its sole discretion, to cede and/ or transfer to any 3rd (third) party all or any of its rights and/ or obligations under this contract without the need for your consent or notice thereof. This contract contains all the terms and conditions and no representation, addition, variation or cancellation of this contract shall be enforceable unless presented in writing and signed by all parties. Performance Purist (Pty) Ltd reserves the right to alter/ change the terms and conditions of this contract from time to time, as and when necessary.

Membership Fees

Your membership contract fee is determined specifically by the option that you have selected. All membership fees are payable by monthly debit order, payable on the 1st business day of each month, in arrears. The current month’s membership fee will be debited on the 1st business day of
the next month. All private and semi-private sessions that fall outside of your contract selection, will be recorded and billed in conjunction to your monthly membership fee as a single debit order, payable on the 1st business day of the month, in arrears. Performance Purist (Pty) Ltd reserves the right to alter the contract options and associated fees with a 30 (thirty) day notice period to each member. Performance Purist (Pty) Ltd reserves the right to determine any fee increases as may be seen necessary, with a 30 (thirty) day notice to all members.

Should any of your details change, it is your responsibility to notify Performance Purist (Pty) Ltd of such changes. Should you fail to make your monthly payment, you will be liable to make an immediate payment arrangement with Performance Purist (Pty) Ltd. This may include, but is not limited to a double debit for the next month, a forced debit order on the account, an EFT payment, cash payment, card payment within the facility or as otherwise accepted by Performance Purist (Pty) Ltd. Should you fail to pay for any private and semi-private sessions as invoiced for the previous month, Performance Purist (Pty) Ltd reserves the right to immediately suspend your contract which will include any use of the facility, all group training, as well as further private and/ or semi-private sessions until such time that the amount due is settled in full.

Performance Purist (Pty) Ltd reserves the right to charge an additional fee for any and all debit orders which may be returned/ declined for whatsoever reason. The fee charged will be determined at the discretion of Performance Purist (Pty) Ltd to reasonably cover the costs incurred for any rejected debit orders. You understand and agree that this could include, but is not limited to debit order rejection fees as charged by the collecting agent, advisory and legal costs, as well as any costs for debt collection services.

Membership Options

Two membership types exist: Group Training Options and Semi Private Training Options

A – Group Training
This option allows you to enjoy up to a maximum of however many group sessions you have selected per week, namely 2 (two), 4 (four) or Unlimited. You have the freedom to decide upon the mix of sessions from any of the group sessions on offer at any time. Should you attend more group sessions in any particular week than your selected contract option allows for, you will be billed for each additional session at a rate of R 125 per session.

B – Semi-private Training
This option allows you to select the type of private (1 on 1) or semi private (2 on 1, or 3 on 1) sessions you may attend per month, with your selected trainer. Semi-private sessions are not transferable and/ or exchangeable and missed sessions do not accumulate from month to month. The onus falls explicitly on the member to make use of all the allotted semi-private sessions per month, as per the selected contract option. Members are billed on a per session basis, with a minimum of 6 sessions being billed per month

Private 1 on 1 sessions will be billed at R 500 per session
Semi-private 2 on 1 sessions will be billed at R 350 per session
Semi-private 3 on 1 sessions will be billed at R 300 per session

Contract Upgrade/ Downgrade

Either contract option can be upgraded or downgraded with a 30 (thirty) day written notice period. No contract downgrades will be accepted over the December or January months.

Should you have a dispute with regards to private and/ or semi-private billing, you may address it first with your trainer and if no resolution is reached, then take the matter up with Performance Purist (Pty) Ltd management.

Complaints

Please address any and all complaints of whatsoever nature to Performance Purist (Pty) Ltd management in writing at your earliest convenience. Complaints can be directed to info@performancepurist.co.za

Your obligation to report

You agree to immediately report the following (but not limited to) directly to Performance Purist (Pty) Ltd management:
Any and all damage/ fault to/ with the facility and/ or equipment, whether occurred prior to or during your arrival/ use/ departure
Any misuse of the facility and/ or equipment by any member, visitor, employee or otherwise
Any mistreatment directed towards member, visitor, employee or otherwise by any member, visitor, employee or otherwise.

Personal Information

By signing this contract, you agree to our Member Information Terms and Conditions policy, a copy of which can be attained by request at any time. Our policy illustrates the manner in which we collect, store and utilize member information, with specific focus on the Protection of Personal Information.

Acknowledgement of Member

You acknowledge the following:

• You have read and fully understand this entire contract
• The information provided by you in this contract is true to the best of your knowledge
• To familiarize yourself with the rules governing the facility from time to time
• You are authorised to sign this contract
• You are able to afford the monthly membership fees payable in this contract
